Templates for mining activity specifications

1421 corresponding to 3 July 2001 setting out mining law and especially its
article 85;

In view of Presidential decree No. 90-198 of
30 June 1990 relative to the regulation of explosive substances;

In view of executive decree No. 96-214 of 28
moharram 1471 corresponding to 15 June 1996 setting out the powers of the
Minister of Energy and Mining;

Rajab 1419 corresponding to 3 November 1998 defining the regulations applicable
to rated installations and setting their ratings;

Dhou el Kaada 1422 corresponding to 6 February 2002 defining the terms and
procedures for granting mining titles;

Dhou el Kaada 1422 corresponding to 6 February 2002 defining the terms for
awarding mining titles.
Decrees:
Article 1
In
application of the stipulations of law No. 01-10 of 11 Rabie Ethani 1422
corresponding to 3 July 2001 setting out mining law, and especially its article
85, this decree is intended to set out the templates of specifications to be
signed by parties granted the following mining titles:
§
prospecting authorization;
§
exploration permit;
§
operating permit for small or medium sized
mining operations;
§
authorization to operate a very small-scale
mining activity.
Article 2
The
specifications template attached to the prospecting authorization is set out in
Appendix I of this decree.
Article 3
The specifications template attached to the exploration permit is set out
in Appendix II of this decree.
Article 4
The specifications template attached to
the operating permit for small or medium sized mining operations is set out in
Appendix III of this decree.
Article 5
The specifications template attached to the operating authorization for very small-scale mining operations is set out in Appendix IV of this decree.
Article 6
Drawing up
specifications is up to the applicant who must provide them in four (4)
original copies, on unstamped A4 size paper.
The four
(4) original copies will be distributed as follows:
§
the first one for the Wali with territorial
authority,
§
the second one for the National Geology and
Mining Inspectorate,
§
the third one for the National Mining Agency,
§
the fourth one for the applicant, after
receiving the registration number issued by the National Mining Agency.
Article 7
This
decree will be published in the Official
Journal of the People's Democratic Republic of Algeria.
