Order of 26 Chaoual 1423 corresponding to 30 December 2002 establishing
the list of mineral substances
The Minister of Energy and Mining,
Given law n°01-10 of 11 Rabie Ethani 1422 corresponding to 3 July 2001 Mining Law, notably article 160 ;
Given Presidential Decree No. 02-208 of 6 Rabie Ethani 1423 corresponding to 17 June 2002 concerning nomination of members of the Government;
Given Executive Decree No. 96-214 dated 28 Moharram 1417 corresponding to 15 June 1996 fixing the responsibilities of the Minister of Energy and Mining;
Hereby orders:
Article 1: This order is intended to specify, in conformity to the provisions of article 160 of law No. 01-10 of 11 Rabie Ethani 1422 corresponding to 3 July 2001, the list of substances constituting mineral substances covered by annexe 3 of the said law.
Article 2: Mineral ores are considered as ferrous metal minerals if they contain the following elements:
Iron, Manganese, Chromium, Titanium, Nickel, Cobalt
Article 3: Mineral ores are considered as non-ferrous metal minerals if they contain the following elements:
magnesium, aluminium, beryllium, lithium;
lead, zinc, copper, antimony;
wolfram, tin, mercury, arsenic, molybdenum, zirconium, bismuth;
germanium, cadmium, gallium, vanadium;
uranium, thorium, other radioactive elements;
tantalum, niobium;selenium;
rare earths
Article 4: The following mineral substances are considered as non-metallic minerals:
coal, anthracite, lignite, bituminous schistes;
graphite;
sand for blast works and foundries;
diatomites (kieselguhr);
calcite, dolomite; asbestos, talc, micas; pumice, pozzolane;
bleaching earth, bentonite, ghassoul, attapulgite;
perlites;
kaolin, pegmatite, feldspar; barytine, strontium (celestine), fluorine;
phosphates;
sodium salts, potassium salts, nitrates, other salts; sulphur;
andalousite, sillimanite, disthene;
quartz
Article 5: The following minerals are considered as non-metallic substances for construction:
limestone, sandstone and other similar substances intended for aggregates;
schistes, slates;
marble, travertine, aragonite, ornamental limestone, serpentine, granite, onyx and ornamental stones;
gypsum, anhydrite;
clays, marls;
tufa;
building sand.
Article 6: The following are considered as precious metals, precious stones and semiprecious
metals:
gold, silver, platinum, group element, platinoides
diamond
topaz, agate, garnets, rubies, sapphire, emerald, beryl, zircon, corindon and other semiprecious stones
Article 7: The lists of mineral substances are not exhaustive and may be modified.
Article 8: This order will be published in the official journal of the Democratic and Popular Republic of Algeria.
