Annual report on mining activity

 

The Minister for Energy and Mining,

Given law n°01-10 of 11 Rabie Ethani 1422 corresponding to 3 July 2001 Mining Law, notably article 152, 169 and 173;

Given Presidential Decree No. 03-215 of 7 Rabie El Aouel 1424 corresponding to 9 may 2003 concerning nomination of members of the Government;

Given Executive Decree No. 96-214 dated 28 Moharram 1417 corresponding to 15 June 1996 fixing the responsibilities of the Minister of Energy and Mining;

Hereby orders:

Article 1: In application of the provisions of law no. 01-10 of 11 Rabie Ethani 1422 corresponding to 3 July 2001, the mining law, notably article 152, this order fixed the essential parameters to be included in the annual mining report.

Article 2: The annual mining report contains five (5) chapters as listed below:

- Chapter 1 concerning general data

- Chapter 2 containing technical data

- Chapter 3 containing data on safety at work

- Chapter 4 containing restoration of the site

- Chapter 5 concerning analysis of envisaged measures and those deployed.

The model annual report is given in annexes 1, 2 and 3.

Article 3: Chapter 1 concerning general data incorporates general parameters for the activity, notably:

-For the holder of a prospecting or exploration permit, information on the permit, personnel and resources in place and organisation of work.

-For the holder or exploitation mining title or exploitation permit.

• information concerning the permit (surface area, substance mined, date of issue, validity)

• production of all the extracted run of mines and its grade

• marketable production and the content

• personnel

• organisation of the work

Article 4: Chapter 2 concerning technical data contains parameters linked to progress on mining works which are:

-For the holder of a prospecting or exploration permit:

• a statement of the works carried out (drilling, mining works, cuttings, excavations etc.) and the results recorded:

- For the holder of exploitation mining title or exploitation permit:

• volume of prospecting/exploration works performed in each district, lode

• volume of preparatory works in each section district, lode

• tonnages extracted of sterile and of minerals per district, bench

Article 5: Chapter 3 concerning safety data consists in notifying statistics on accidents at work and occupational diseases:

- number of accidents (NA) and days lost (NJP)

- rate of frequency of accidents (TF) and rate of gravity (TG)

- occupational diseases.

Article 6: Chapter 4 concerning restoration of the site consists in submitting operations for restoring the site performed, notably:

- volumes of excavations filled in

- surfaces which have been landscaped and/or planted with trees

- all works intended to preserve public safety and the atmosphere

Article 7: Chapter 5 consists in conducting an analysis and comments on key points in articles 3, 4, 5 and 6 and presenting measures adopted and/or to be adopted in the future.

Article 8: The annual report on mining will be accompanied by plans and cross sections at appropriate scales depending on the surface area to be covered:

- 1/25000 and 1/50000 or 1/100 000 for prospecting and exploration reports

- 1/200, 1/500, 1/1000, 1/2000, 1/5000 for exploitation and exploration reports

The documents constituting the annual report referred to in sub-paragraph 1 above, must be submitted to the central registered office of the Agence Nationale du Patrimoine Minier and the Agence Nationale de la Géologie et du Contrôle Minier and/or their regional offices, in return for acknowledgement of receipt, at the latest on the 31st of January of each year following the previous year.

Article 9: Failure to comply with the deadlines in article 8 above will result in application of the penalties specified in the mining law.

Article 10: The Agence Nationale de la Géologie et du Contrôle Minier may, in the case of need, request additional information linked to safety at work, stability of land, public safety and protection of water tables and restoration of the site.

Article 11: This order will be published in the Official Journal of the Democratic and Popular Republic of Algeria.
